Privacy Policy

This Policy was last updated on 12 February 2026.

This Policy sets out Crowies Paints Pty Ltd ABN 67 066 584 950 and its associated entities (together Crowies Paints, we, us or our) the collection, storage, usage, management and protection of your personal information and credit related personal information. This Policy is based on our obligations under the Privacy Act 1988 (Cth) (Privacy Act) (including Australian Privacy Principles (APPs), Part IIIA (credit reporting provisions) and the Credit Reporting Privacy Code (CR Code).

The definition of Crowies Paints under this Policy includes:

  1. Evanstone Hardware Pty. Ltd. ACN 008 172 272;
  2. Crowies Paints Franchisor Pty Ltd ACN 633 912 455;
  3. Crowies Paints Pty Ltd ACN 634 089 384;
  4. Crowies Paints Holding Pty Ltd ACN 634 407 533; and
  5. Crowies Coatings Pty Ltd ACN 674 307 370.

By:

  1. using our services (Services);
  2. accessing, requesting information on, enquiring about, using, receiving or providing feedback in relation to, Crowies Paints operations or services (online, in writing, by telephone or in person); or
  3. otherwise providing to or consenting to the collection of Personal Information by Crowies Paints, its officers, agents or employees,

after this Policy has been brought to your attention, you acknowledge and consent to the use, collection, storage or disclosure of your Personal Information by us in accordance with this Policy and the Privacy Act.

If you do not agree to us handling your Personal Information in the manner set out in this Policy you must immediately cease to access our Services, and you should not provide us with any of your Personal Information.

This Policy is periodically reviewed. From time to time we may make changes to this Policy. When we do, we will highlight those changes in yellow highlight for a period of 14 days. Changes come into effect from the time when they are brought to your attention, or when you next log on to our website, whichever is earlier. Please make sure you review the Privacy Policy each time you visit our website to keep up to date on any changes.

Please note that Crowies Paints' website contains links to other websites. When a user has clicked on a link to another site, they leave the Crowies Paints site and are no longer protected by this Policy.

PART A - MANAGEMENT OF PERSONAL INFORMATION

1. What is Personal Information?

We follow the definition of Personal Information given in the Privacy Act:

Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable:

  1. whether the information or opinion is true or not; and
  2. whether the information or opinion is recorded in a material form or not.

2. Collection of personal information

Crowies Paints collects and/or holds different Personal Information about you depending upon how you interact with us. This information may vary depending on the specific needs of Crowies Paints, however, it may include your:

  1. image;
  2. location and activities;
  3. contact information such as name, postal address, private address, email address, telephone numbers and date of birth;
  4. demographic information;
  5. comments and feedback;
  6. messages, emails, voicemail and other correspondence;
  7. responses to surveys;
  8. your interaction with websites, including our website;
  9. what computer configurations and software you use;
  10. financial details;
  11. ABN;
  12. name of current employer or education (as applicable);
  13. your business history with us;
  14. your business or associated companies or entities;
  15. your preferences;
  16. your relationship with us;
  17. the frequency of your enquiries;
  18. your location;
  19. how and when you use our Services;
  20. your server address;
  21. your top level domain name (for example, .com, .gov, .au etc);
  22. the date and time of your visit to the site;

  26. any other information voluntarily provided by you through our website.

3. Purposes for collection

Personal information may be collected, held, used and disclosed by Crowies Paints for the following purposes:

  1. providing you or a third party with Services;
  2. providing you with information about our Services or products;
  3. providing third parties with information about you and your use of our Services or products;
  4. developing or refining our Services or products;
  5. internal business purposes;
  6. providing you with marketing material;
  7. contacting you in relation to our business activities;
  8. better understanding our clients, customers and stakeholders;
  9. tailoring our Services;
  10. publishing testimonials you provide us;
  11. corporate governance, auditing and record keeping; and
  12. arrange and provide credit;
  13. verifying an individual's identity;
  14. resolve a complaint;
  15. other purpose related to any of the above.

Our use of Personal Information may extend beyond these uses, but will be restricted to purposes that we consider to be related to our functions and activities.

4. Means of collection and holding of personal information

Crowies Paints collects only the information voluntarily supplied by you through our credit application forms, our website forms and verbally in store or when conducting our Services, we may also receive personal information from third parties who you have authorised to provide us with information. If the personal information is not collected, Crowies Paints may not be able to provide you with the products or services requested.

Crowies Paints holds all personal information in electronic and physical form. We store information in access controlled premises and in offsite electronic databases requiring logins and passwords.

Crowies Paints is committed to keeping secure the personal information you provide us and we will take all reasonable precaution to protect your personally identifiable information from loss, misuse, interference, unauthorised access or alteration.

We aim to achieve this through:

  1. imposing confidentiality requirements on our employees;
  2. implementing policies in relation to document storage security;
  3. implementing security measures to govern access to our systems;
  4. only providing access to personal information once proper identification has been given;
  5. controlling access to our premises; and
  6. implementing website protection measures.

We conduct regular audits of our compliance with this Policy and the Privacy Act to ensure that our privacy framework is in line with industry best-practice.

6. What do we do with your Personal Information?

If we collect Personal Information from you, we may:

  1. use that information for any of the purposes in clause 3 of this Policy;
  2. store that information in accordance with this Policy;
  3. pass that information amongst entities we work with;
  4. pass that information to third parties who provide products or services to us (including our accountants, auditors, lawyers, IT contractors, and other service providers);
  5. provide that information to third parties as notified by us from time to time; or
  6. provide that information to third parties as required by law.

Crowies Paints has a duty to keep our customers' personal information confidential. Our duty of confidentiality applies except where we have consent to disclose personal information, the disclosure is permitted under the APPs or is compelled by law.

Crowies Paints may disclose your personal information to necessary third parties, who assist us to provide, manage and administer our services and products. In which case, your personal information will be dealt with in accordance with that entity's privacy policy. No personal details are provided to any other individual or organisation, except with your consent. We do not directly disclose your personal information to overseas recipients.

7. Do you use my information for Direct Marketing?

We may use your Personal Information to communicate directly with you to promote our products or Services. We use direct marketing to provide you with information about products or services that we believe you may be interested in. If you receive direct marketing material from us, and do not wish to continue receiving it, please contact us by any of the methods set out in clause 18 below, asking to be removed from all future direct marketing programs. Once we have received your opt-out request, we will remove you from our direct marketing programs as soon as reasonably practicable.

8. What about Cookies, pixels and analytics?

When you access our website, we may receive information about you via a 'cookie', a 'pixel' or from analytics software.

These tools are pieces of information that our web server may send to your computer, or embed on a website, when you visit the website. These tools help us to recognise when you re-visit the website, and to optimize your experience. We generally don't collect Personal Information through the use of these tools, though we may be able to access your IP address and information about what your computer technology is when using analytical software.

9. Do you ever send your information overseas?

  1. Crowies Paints may upload images and/or footage to its social media accounts from time to time. The social media accounts may be hosted on an overseas server. Where applicable, in the event that your information is sent overseas, Crowies Paints will use its best endeavours to ensure that any overseas supplier will keep all Personal Information secure.
  2. We are an Australian organisation providing products and services within Australia. From time to time, we may inadvertently capture or collect Personal Information that passes through the European Union. This might occur, for example, if a person in the European Union accesses our website and we collect analytical data about them, if a person in the European Union signs up for a newsletter, or if you give us information about your activities the European Union. If this occurs, we will treat the Personal Information received in accordance with this policy. By providing us with such Information, you consent to its collection and treatment in accordance with this Policy.

10. Access to information and seeking correction

  1. You may request access to the Personal Information that we hold about you by contacting us by any of the methods as set out in clause 18.
  2. Upon receiving an access request we may request further details from you to verify your identity. We reserve the right not to provide you with access to Personal Information if we cannot verify your identity to our reasonable satisfaction.
  3. An administrative fee may be charged to cover our costs in providing you with access to your Personal Information. This fee will be explained to you before it has been incurred.
  4. We will respond to your access request within a reasonable period of time by:
    1. providing you with access to your Personal Information;
    2. rejecting your access request, and providing you reasons for this rejection.
  5. Access requests may be denied where:
    1. we believe your request is frivolous or vexatious;
    2. we are entitled to reject a request by law;
    3. we are unable to verify your identity; or
    4. you have not paid the administrative fee referred to in clause 10(c), above.
  6. If you believe that the Personal Information that we hold is inaccurate or otherwise requires correction, you may send us a correction request by contacting us by any of the methods set out in clause 18, below. We will review your Personal Information and respond to the request within a reasonable period of time.

11. Dealing with us anonymously

The circumstances in which you can deal with Crowies Paints anonymously or using a pseudonym include:

  1. making a general enquiry about the services that we can offer to you, including in person at one of our stores; and
  2. posting on our blog.

You may request at the start of any telephone call with us, in relation to a general enquiry, to remain anonymous (or you may use a pseudonym). You will also be given the opportunity to remain anonymous (or use a pseudonym) when completing a website enquiry form.

PART B - MANAGEMENT OF CREDIT RELATED PERSONAL INFORMATION

12. Collection of Credit Related Personal Information

Crowies Paints may collect, use, hold and disclose the following types of credit related personal information:

  1. identification information- name, current or previous address type and amount of credit sought;
  2. publicly available information about an individual's creditworthiness;
  3. default information;
  4. repayment history information;
  5. payment information in relation to an overdue payment;
  6. court proceedings information;
  7. personal insolvency information; and
  8. trade references (with your consent).

Credit related personal information is managed by Crowies Paints in accordance with the procedures set out in Part A of this Policy, unless provided otherwise in this Part B.

13. Means of collection of credit related personal information

In addition to the methods above, Crowies Paints may collect credit related personal information from other credit providers, subject to any restrictions in the Privacy Act.

14. Request for Access or Correction to the Credit Information

A request for access to your credit eligibility information or for the correction of your credit information or credit eligibility information can be made following the procedures set out in Part A of this Policy.

We will respond to your request for access to credit eligibility information within a reasonable time after you make the request and if access is granted, access will be provided within 30 days from your request. Your request for correction will be dealt with within 30 days, or such longer period as agreed by you.

If we deny your request for access or correction, we will provide you with a written notice detailing reasons for the refusal and the process for making a complaint about the refusal to grant your request.

15. Request for access

We will accept your request for access unless:

  1. giving access would be unlawful;
  2. we are required or authorised by law or a court/tribunal order to deny access; or
  3. giving access is likely to prejudice one or more enforcement related activities conducted by an enforcement body.

Where your request for access is accepted, we will provide you with access to your personal information in a manner, as requested by you, providing it is reasonable to do so.

16. Request for correction

We will accept your request for correction where we are satisfied that your credit related personal information is inaccurate, out-of-date, incomplete, irrelevant or misleading.

If your request for correction of credit related personal information is accepted we will provide written notice of this correction to any entity to which we have disclosed this information previously, to the extent that this is practicable.

PART C - GENERAL

17. Complaints

If you believe that Crowies Paints have breached a term of this Policy, the APPs, the credit reporting provisions or CR Code, you may submit a written complaint. The written complaint can be emailed or posted to us using the contact details set out below. You must include contact details for us to contact you regarding your complaint. Our Privacy Officer will consider your complaint and respond as soon as reasonably possible, but not more than 30 days from receiving the complaint.

If you are unsatisfied with the outcome of your complaint you may ask the Privacy Officer to be referred to a higher authority within the company, such as the Managing Director. If you still remain unsatisfied with the outcome, you may refer your complaint to the Office of the Australian Information Commissioner to be resolved.

If you wish to:

  1. gain access to your personal information;
  2. make a complaint about a breach of your privacy;
  3. contact us with a query about how your personal information is collected or used;
  4. contact us regarding any other matter concerning this Policy,

you can speak directly with our staff who will do their best to try to resolve your issue as simply as possible. Alternatively, you can write to us or send us an email so that our Privacy Officer can consider the matter. We will respond to you as soon as reasonably possible.

(When contacting us, you can do so either anonymously or by using a pseudonym. If, however, you do so we may not be able to provide you with accurate or useful information, and you may not be able to access a full range of our operations and services. Further, we may not be able to investigate incidents or complaints you have made.
